Jeffrey W. Gasbarro focuses his practice on civil appeals and litigation, leveraging his experience working as a court attorney and law clerk for over a decade at the Appellate Division, Second Department, where he handled all types of civil, criminal, and matrimonial matters. Jeff's experience working behind the scenes at one of the busiest appellate courts in the country gives him a unique perspective to craft the best approach to protect our clients’ interests. Jeff has successfully argued appeals in the First, Second, and Third Departments. Additionally, Jeff regularly handles matters arising under the New York State Election Law, where candidates’ places on the ballot are often at stake.

Jeff serves as a Reporter to the committee comprised of New York Judges that publishes the New York Pattern Jury Instructions (known by practicing attorneys and judges simply as the “PJI”), a four-volume treatise containing jury instructions and legal commentaries. The PJI is used in every civil jury trial in the State of New York.

  • Sutton v Syla: Appellants’ claims of neglect by their former counsel did not constitute grounds to vacate a judgment (223 A.D.3d 764 [2d Dept 2024]).

  • Minichino v Fox: Election Law proceeding to invalidate the results of a judicial nominating convention was barred by the statute of limitations (81 Misc3d 405 [Supreme Court, Albany County 2023], aff’d 219 A.D.3d 1637 [3d Dept 2023], lv denied 40 N.Y.3d 905 [2023]).
